Terms of Service
Effective Date: March 1, 2026
Article 1. Purpose and Definitions
These Terms of Service (hereinafter 'Terms') set forth the conditions and procedures for use of the spatial regulation judgment API service (hereinafter 'Service') provided by XAND (hereinafter 'Company'), and the rights, obligations, and responsibilities of the Company and users.
1. 'Service' refers to all services provided by the Company in SaaS (Software as a Service) form, including the spatial regulation judgment API, developer portal, dashboard, and related services.
2. 'User' refers to any person who uses the Service provided by the Company in accordance with these Terms.
3. 'API Key' refers to a unique authentication credential issued by the Company to users for Service access.
4. 'Content' refers to all information provided through the Service, including regulation judgment results, spatial data, and documentation.
Article 2. Service Description
The Company provides the following services:
1. Spatial Regulation Judgment API: Coordinate-based judgment of 6 types of legal regulations (zoning, school protection zones, national heritage zones, government facilities, military facilities, airspace)
2. Bulk API: Batch regulation judgment for up to 1,000 coordinates
3. Developer Portal: API documentation, API key management, usage analytics dashboard
4. Other supplementary services as determined by the Company
Article 3. Registration and Account Management
1. Users may apply for registration through the procedures established by the Company, and the service agreement is established upon the Company's approval.
2. Users must provide accurate information during registration and promptly update any changes.
3. Users are responsible for securely managing their account information and may not transfer or lend it to third parties.
4. All liability arising from unauthorized use of an account lies with the user.
Article 4. API Key Issuance and Usage Conditions
1. Users may issue API keys through the developer portal.
2. API keys are for the sole use of the issued user and must not be shared with or disclosed to third parties.
3. If API key leakage or unauthorized use is confirmed, the Company may immediately revoke the key without prior notice.
4. Users bear full responsibility for the secure storage of their API keys.
Article 5. Fees and Payment
1. Service fees are determined according to the pricing plans established by the Company, including Free, Starter, Pro, and Enterprise.
2. Payment for paid services is processed via card and easy payment methods through TossPayments.
3. Plan upgrades take effect immediately; downgrades take effect at the end of the current billing cycle.
4. The Company may change fees with 30 days' prior notice.
Article 6. Data Ownership and Intellectual Property
1. Intellectual property rights in the Service, including its software, technology, and design, belong to the Company.
2. API response data may only be used for the User's service operations and may not be resold or redistributed.
3. Ownership of coordinate data submitted by the User to the Service remains with the User.
Article 7. Prohibited Activities
Users must not engage in the following activities:
1. Activities that interfere with stable service operations (excessive requests, DDoS attacks, etc.)
2. Reverse engineering, decompiling, or disassembling the Service
3. Unauthorized resale of API response data or use in building competing services
4. Misuse or unauthorized use of another user's API key
5. Using the Service for content exposure judgment that violates applicable laws
6. Other activities that violate applicable laws or these Terms
Article 8. Service Interruption and Changes
1. The Company may temporarily suspend the Service for unavoidable reasons such as system maintenance, equipment replacement, or technical issues.
2. Scheduled maintenance will be announced in advance; emergency maintenance may be notified after the fact.
3. The Company may modify or discontinue all or part of the Service with 30 days' prior notice.
Article 9. Disclaimer
1. The Company is not liable for inability to provide the Service due to force majeure such as natural disasters, war, or telecommunication service interruptions.
2. The Service is provided 'AS-IS,' and the Company does not guarantee the legal accuracy of regulation judgment results.
3. Users should treat API response data as reference material; final legal determinations should be obtained through official confirmation from the relevant authorities.
4. The Company is not liable for service disruptions caused by the User's own actions.
Article 10. Termination and Refunds
1. Users may terminate their service agreement at any time through their account page.
2. Upon termination, Users may continue to use the Service for the remainder of the current billing cycle.
3. Free plan users are not subject to refund provisions.
4. Refunds for paid plans are governed by applicable laws and the Company's refund policy.
Article 11. Governing Law and Jurisdiction
1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
2. The Seoul Central District Court shall have exclusive jurisdiction over any disputes arising from the use of the Service.
Article 12. Effective Date
These Terms of Service are effective as of March 1, 2026.
